PRIVACY POLICY

This Privacy Policy explains how and why buyers' personal data is collected, used, stored and shared when they place an order, request assistance, submit a customization request or use the Tramapura shop services through Etsy.

This Policy applies only to processing carried out by Tramapura. It does not cover the activities of Etsy or other third parties that are not directly controlled by the seller. Etsy and the seller act as independent data controllers for personal data processed within their respective services.

2. Personal data collected

To process and complete an order, the seller may process data provided by the buyer to Etsy and then shared with the seller, including:

first and last name;
email address;
billing and shipping address;
telephone number, when required by the carrier;
information about the order and the purchased product;
the content of communications sent through Etsy;
names, photographs, images, text, dates or other information voluntarily supplied for customized items.

The seller does not directly receive complete payment card details. Those details are managed through the payment systems provided by Etsy.

3. Purposes and legal bases

Personal data is used only when necessary to:

process, make, customize, pack and ship orders;
communicate with the buyer and provide assistance before and after the sale;
manage requests, changes, returns, refunds, claims or disputes;
comply with tax, accounting, administrative and legal obligations;
prevent fraud, abuse or unlawful use of services;
protect the rights of the seller and buyers;
comply with Etsy's Terms of Use and Seller Policy.

Processing is based on performance of the sales contract, compliance with legal obligations and, where applicable, the seller's legitimate interest in providing and improving its services.

The buyer's data will not be used for advertising or promotional communications without prior, freely given and explicit consent. Etsy states that data received to complete a transaction may not be used for promotional purposes without the buyer's consent.

4. Data sharing

Personal data may be shared, only to the extent necessary, with:

Etsy, to operate the platform and manage orders, payments and assistance;
carriers, shipping providers and customs operators, to complete delivery;
tax, accounting or legal advisers, where necessary;
technical or IT service providers used to operate the business securely;
public, administrative, tax or judicial authorities, where required by law.

Personal data is not sold, transferred or disclosed to third parties for their own independent commercial purposes.

5. Customized items

Photographs, images, names, dates and other content supplied by the customer to create a customized product will be used only to prepare the order, provide related assistance and manage any claims.

This content will not be published, reproduced for promotional purposes or used to create other products without the data subject's consent.

6. Data retention

Personal data is kept only for as long as necessary to manage the order, provide assistance and meet any legal obligations.

Information contained in tax and accounting records may be retained for up to 10 years, or for any different period required by applicable law. Italian law provides for accounting records to be retained for ten years.

Files and content supplied for customization are retained only for the time needed to complete the order and manage any later requests, unless a longer period is required by law or necessary to protect a right in the event of a dispute.

7. International transfers

Because Etsy and some service providers may operate in countries other than the buyer's country, some data may be processed outside the European Economic Area. Such processing will be carried out in accordance with applicable law and the safeguards adopted by the parties involved.

When an order is delivered abroad, the information required for shipping may be disclosed to the carrier and to the customs authorities in the destination country.

8. Data subject rights

Where provided by law, the buyer may request:

access to personal data;
correction of inaccurate data;
deletion of data;
restriction of processing;
objection to processing;
data portability;
withdrawal of any consent previously given.

Deletion may not be possible where retention is necessary to meet tax or legal obligations, manage a dispute or protect a legal right. The GDPR recognizes rights of access, rectification, erasure, restriction, objection and portability.

The data subject may also lodge a complaint with the Italian Data Protection Authority or the competent supervisory authority in their country.

Requests concerning data held directly by Etsy should also be submitted to Etsy through its support channels.
